Start With a Title Search
A title company can identify recorded mortgages, liens, judgments, ownership interests and other items that may need to be addressed before closing. Do not assume that an old debt disappeared just because no one has mentioned it recently.
We have seen transactions where the seller believed title was clean and a decades-old issue appeared during escrow. Finding it early gives everyone more time to solve it.
Common Problems That Can Delay a Sale
Examples include HOA liens, tax balances, judgments, unpaid contractor claims, deceased owners still on title, divorce-related ownership questions, unreleased loans, code-enforcement cases, unpermitted work and disagreements between owners.
Some of these can be paid or cleared at closing. Others require action before the title company can insure the transfer.
Code Violations Do Not Always Mean You Must Repair Everything First
Depending on the municipality and violation, a buyer may be able to purchase the property and take responsibility for corrective work after closing. Other violations may require action sooner. The details matter.
Before spending thousands of dollars, find out what the city actually requires and whether an as-is buyer is willing and able to take on the work.
Unpermitted Additions and Improvements
Older Arizona properties sometimes have converted garages, additions, guest houses or other improvements where the permit history is unclear. That can affect financing, appraisal, insurance and buyer expectations.
A cash buyer may have more flexibility than a financed retail buyer, but the condition and legal status still need to be evaluated honestly.
